the Island where their said Cable is intended to be

landed, and also affix a wire or wires for the use

of the Company to the posts of the Government Tele-

graph between Deep Water Bay and the Offices of the

Company in Victoria,

And Whereas the actual cost of erecting the posts

and of affixing the wire of the Government Telegraph

has been Two hundred and eighty two dollars per mile,

and the cost of affixing a second wire thereto for

the use of the Company is estimated at Forty seven

dollars per mile, making a total of Three hundred

and twenty nine dollars per mile. And Whereas per-

mission has been granted by the Government to the

Company to erect such Block House as aforesaid and

also to use the said posts of the Government Tele-

graph for the purposes aforesaid upon the terus

hereinafter mentioned. No w these

sent s Witnes S that it is hereby agreed

by and between the parties hereto as follows:-

1. The Company have permission to land a Submarine

Telegraph Cable at Deep Water Bay in this Colony

and to maintain and work and use the same upon

and subject to the conditions of Articles 6, 9,

and 10 of this Agreement.

2.

The Company may erect and maintain a Block

House on the Sea Shore at Deep Water Bay, paying

to the Government for the same, and for the use

of such portion of the shore between the Block

House and low water mark as may be necessary for

the purpose of maintaining their Cable, a non-

inal rent of one Dollar per annum. Provided

Always that such Block House shall be erected and used

for the purpose only of securing the shore end of the said cable and for protecting the connection of the

Land Line therewith, and not be used as a residence

for any servants of the Company other than watchmen.

An additional wire and such additional posts as

may be necessary shall be forthwith affixed by the

Government on their Telegraph line between Victoria

and Deep Water Bay for the use of the Company for the

purpose of establibing Telegraphic communication

between the said Elock House and the Offices of the

Company in Victoria, and such additional wire and

posts shall be of the same description as the present

wire and posts of the Government Telegraph.

4.

The Company will pay to the Government one balf

the total cost of erecting all the Posts to be used

by the Company and of both the original and the new

wires, that is to say at the rate of One hundred

and sixty four dollars per mile.

5.

The Government and the Company will defray in

equal shares the expense of maintaining and renewing

the said posts and Wires and of keeping them in good

working order and condition. Provided Always that in

case any other Telegraph Company shall apply to the

Government for permission to use the said Telegraph

Posts such permission shall not be granted except on

the condition that such other Company contribute rate-

ably with the Government and the Company (party hereto)

to the costs of the maintenance and renewal thereof.

6.

The repairs to all such posts and wires as afore-

said shall be effected by the Government who hereby

undertake to keep the same in good working order.
